1. Introduction

Come Together is a technology platform provided by Bitopia LLC ("Bitopia") that allows Organizations to manage events, communities, bookings, participants, users, and other operations through its products and services.

To provide, maintain, protect, and improve these services, Bitopia may use third-party providers that render infrastructure, hosting, storage, communications, security, and other technological services and functionalities.

When these providers process personal data on behalf of Bitopia, acting in its capacity as a processor for an Organization, they may act as subprocessors.

This document explains how to consult available information regarding such providers and how their involvement relates to Come Together services.

2. Responsibilities in Data Processing

Organizations using Come Together may act as controllers of the personal data they collect and manage through the Platform.

In such cases, Bitopia may act as a processor, providing the corresponding technological services in accordance with authorized instructions and applicable agreements.

Bitopia may also act as a controller regarding certain data related to its own operations, commercial administration, security, support, and other purposes described in the Privacy Policy.

Each party's role will depend on the nature of the processing and the corresponding circumstances.

3. What is a Subprocessor

A subprocessor is a third party engaged by a processor to perform specific personal data processing operations on its behalf.

In Come Together, these providers may intervene in functions such as:

  • Hosting and technological infrastructure.
  • Information storage and processing.
  • Communications and messaging services.
  • System security and protection operations.
  • Service monitoring and maintenance.
  • Other technical functions necessary to provide the contracted services.

Not all third-party providers used by Bitopia necessarily hold the status of subprocessor for all operations.

Their classification depends on the service provided, the data involved, and the role they perform.

4. Official List of Providers

Bitopia maintains corporate information regarding its subprocessors through its Trust Center.

Official list of subprocessors:

https://trust.bitopia.digital/subprocessors

This list constitutes the corporate reference for consulting the providers identified by Bitopia as subprocessors.

The inclusion of a provider in said list does not necessarily mean that it intervenes in the processing of personal data for all Come Together products, customers, or implementations.

The providers actually used may vary depending on enabled functionalities, integrations, and contracted services.

5. Selection and Evaluation of Providers

Bitopia endeavors to select providers that offer security and data protection conditions appropriate to the nature of the services they render.

The evaluation and contracting of providers may consider aspects such as:

  • Nature and scope of the services.
  • Types of information processed.
  • Available security measures.
  • Contractual terms.
  • Confidentiality obligations.
  • Data protection requirements.
  • Technical and operational dependencies.

The obligations applicable to each provider will be established in accordance with the corresponding agreements and applicable law.

The use of third-party providers does not exclude the responsibilities that correspond to Bitopia.

6. Integrations Enabled by Organizations

Come Together may allow Organizations to connect external services, such as authentication providers, messaging accounts, or other integrations.

When an Organization directly contracts and manages an external service, that provider does not necessarily act as a subprocessor engaged by Bitopia.

Classification and responsibilities will depend on who contracts the service, who determines the purposes of the processing, and how personal data is processed.

Organizations shall be responsible for evaluating the terms of the providers they directly contract and for securing the necessary authorizations to use their integrations.

Bitopia shall remain responsible for the obligations corresponding to it regarding the integrations and processing it actually performs.

7. Location and International Transfers

Third-party providers may process or store information in different jurisdictions, depending on their infrastructure and the conditions of the corresponding service.

When processing involves international transfers of personal data, Bitopia shall apply the measures and conditions required under applicable law and agreements.

A provider's location does not solely determine the location of all data processed through Come Together.

Specific hosting, data residency, or international transfer conditions that have been contractually agreed upon shall be governed by the corresponding agreements.

8. Provider Updates

The providers used by Bitopia may change as a result of technological, operational, commercial, or security modifications.

Bitopia may incorporate, replace, or cease using third-party providers in accordance with its needs and applicable obligations.

The corporate information available in the Trust Center may be updated to reflect these changes.

When there is a legal or contractual obligation to notify modifications of subprocessors, Bitopia shall comply with the corresponding procedures and deadlines.

This document does not supersede specific notification or objection mechanisms that may be established through commercial agreements.

9. Security and Confidentiality

Bitopia applies technical and organizational measures designed to protect personal data processed through its services.

Third-party providers that intervene in information processing shall be subject to security, confidentiality, and data protection obligations corresponding to their roles, contracts, and applicable law.

Where a Master Subscription Agreement (MSA), order form, or other written agreement is in effect, its provisions shall prevail on expressly regulated matters and in the event of any contradiction, in accordance with the corresponding rules of priority.
